Terms of Service for VoIPXtreme.com

Introduction

VoIPXtreme.com provides the following Terms of Service, which are subject to change at any time, to its customers for the use of their services. These Terms govern all services provided by VoIPXtreme.com to its customers.

Application

These Terms of Service apply to all entities business or residential referred to as customers and/or users of VoIPXtreme.com services.

Restrictions

  • The customer shall not use VoIPXtreme.com as their sole call termination service. It is advised to have a backup solution in case this service does not meet the customer's demands.
  • The customer cannot spread misleading information about VoIPXtreme.com.
  • All information provided to the customer and on the website of VoIPXtreme.com is under the intellectual property of VoIPXtreme.com. The customer cannot use any documents, logo, or information about VoIPXtreme’s technology without a written agreement.
  • Originating calls from payphones to VoIPXtreme.com toll-free numbers is not guaranteed.
  • The customer agrees not to purchase phone numbers from VoIPXtreme.com with the sole intention of porting them out to another service. VoIPXtreme.com reserves the right to disable the purchase of new phone numbers from an account that exhibits this pattern and may charge a port-out fee for numbers removed in this manner.
  • The customer agrees not to start any claim, remedy, or action, legal or otherwise, that may harm VoIPXtreme.com in any way, for any reason related to the services.
  • VoIPXtreme.com agrees not to sell or share the customer's personal or corporate information to third parties, except as permitted by the Terms, in order to provide, support, and secure the services. The customer understands that VoIPXtreme.com may use the services of a third party to render the services or part of the services, and customer data may be hosted by VoIPXtreme.com or their authorized third-party service providers.
  • Caller ID number cannot be changed or blocked for a client unless the client is a reseller and has a trunk with multiple DID’s, business clients and reseller with their own setup can have access to set up the caller ID and names.
  • Telemarketing and unsolicited calls are prohibited on VoIPXtreme.com network, unless the client has prior permission and clearance from VoIPXtreme.com. For Canadian residents and registered companies, it is required that they must prove that they have access to the Do Not Call list available via CRTC, for US registered and residents, it is required they must have access to the National Do Not Call Registry. Failure to obtain proper authorization may result in the suspension of such activities at VoIPXtreme’s sole discretion.
  • If the customer wishes to use any VoIPXtreme.com phone number as their caller ID display for calls related to telemarketing or other purposes, they must obtain written authorization from VoIPXtreme.com. Failure to obtain proper authorization may result in the suspension or removal of the customer's DID number at VoIPXtreme’s sole discretion.

Service Terms

  1. These Terms of Service may be revised. If VoIPXtreme.com chooses to do so, the amended Terms of Service will take precedence over the previous version. Customers will be notified of major changes via email.
  2. The customer is responsible for the safekeeping of their login and password information. If this information is lost or given to any other party, the customer understands that it will be their sole responsibility. The customer agrees to frequently change their passwords to protect their account.
  3. The customer is responsible for all use of non-VoIP services under their account, authorized or not.
  4. VoIPXtreme.com does not guarantee "standard line quality" for its service. The customer understands that the service quality may vary depending on location, internet service provider, and call destination. The level of support and service offered is intended for customers with a higher technical level.
  5. The customer agrees to use the service for lawful purposes and comply with all applicable laws, rules, and regulations.
  6. VoIPXtreme.com makes no warranties, expressed or implied, regarding its product or service.
  7. VoIPXtreme.com will prioritize payment to pay negative balances if any. VoIPXtreme.com will automatically suspend the services as soon as balance goes below minimum threshold of $5, an email will be sent to the client in case of suspension due not non-availability of funds.
  8. VoIPXtreme.com reserves the right to temporarily or permanently discontinue service at any time without notice. In such cases, full refunds will be issued for unused balances.
  9. Rate quotes are valid only on the day they are issued, and the accuracy of rates is the responsibility of the customer.
  10. The free toll-free termination is charged as regular traffic as on Net areas.
  11. The use of scripts that modify the customer portal interface beyond cosmetic modifications is strictly forbidden and may result in account deletion and legal actions.
  12. The customer is responsible for all usage of their account and the actual balance in their account.
  13. The customer may incur a port away fee for any DID numbers leaving VoIPXtreme’s network.
  14. Fees apply when porting numbers from the US and Canada, including resubmission after rejection, cancellation, and expediting fees.
  15. Traffic routed to specific markets will be rated based on durations measured by billing increments.
  16. Information on the VoIPXtreme.com site regarding service, including termination providers, is based on information passed from intermediary companies and may not have been verified.
  17. VoIPXtreme.com does not encrypt transmissions or sensitive parts of customer information in its database. VoIPXtreme.com may voluntarily hand over information regarding customers, usage, and calls if requested by law, court order, or governmental organizations.
  18. By submitting suggestions, feedback, or volunteer contributions, the customer acknowledges that VoIPXtreme.com is not obligated to maintain confidentiality.
  19. Refunds of unused balances are available only where service is terminated by VoIPXtreme.com.
  20. VoIPXtreme.com tracks and screens IP addresses upon logging in and during account sign-up. In some cases, there may be a delay in the login process.
  21. It is the customer's responsibility to verify all numbers delivered to their account before publishing it. VoIPXtreme.com will not be liable for damages or advertising expenses arising from receiving a non-working number.
  22. VoIPXtreme.com shall not be held liable for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including liquidated damages, penalties, lost profit, loss of business, or damages arising from the use of the Service.
  23. These Terms, including any amendments, constitute the entire Agreement between you and the VoIPXtreme.com regarding the Services and supersede any other agreements, written or verbal. If any provision of these Terms is found to be invalid, it will be limited or eliminated to the minimum extent necessary to ensure the remaining Terms remain enforceable.
  24. The customer agrees that the present Terms cannot be assigned or transferred without the VoIPXtreme.com's prior written consent. The Company, however, has the right to assign, transfer, or delegate its rights and obligations under these Terms without customer consent, with prior notice.
  25. Automatic Billing:
    • The VoIPXtreme.com provides an Automatic top-up funds feature, governed by the present Terms and Conditions, available to all clients.
    • The minimum deposit for Automatic top-up funds is USD$10 plus applicable taxes. By using this feature, you authorize VoIPXtreme.com to charge the minimum deposit to the credit card or Paypal account linked to your account. The minimum deposit amount may change from time to time.
    • The Top-up funds Billing feature can be used for all Services provided by VoIPXtreme.com.
    • The VoIPXtreme.com will make its best efforts to ensure the proper functioning of the Automatic Top-up feature. If Auto top-up is not available due to any technical reason, VoIPXtreme.com will send an email message to clients, and the client will have the option to use another method to add funds.
  26. US$10 plus applicable taxes are required to start an account with VoIPXtreme.com.
  27. Phone call conversation / Phone call recordings:
    • The Customer has the option to record phone conversations at their discretion. However, it is the Customer's responsibility to ensure compliance with the laws regarding notice, notification, legality, and use of recorded conversations in their jurisdiction.
    • By using the recording feature, the Customer acknowledges and agrees to be solely responsible for complying with all applicable laws and regulations and warrants that they are acting legally. The VoIPXtreme.com cannot be held responsible for any claims related to the recording of phone conversations, and the Customer agrees to release, indemnify, and hold harmless the VoIPXtreme.com from any such claims.
  28. Customer agrees to promptly respond to traceback requests from authorized traceback administrators and provide collaboration in good faith. Customer's response should indicate if they are the originating provider or a transit provider of the calls and clearly identify the source of the calls to the best of their knowledge.
  29. Customers interested in short-call duration calls services must inquire directly with the VoIPXtreme.com via email. Rates in effect at the time of inquiry will apply to the Short Calls services, unless otherwise agreed in writing.
  30. Resellers of the VoIPXtreme.com's Services must comply with the Terms and Conditions, maintain proper licenses and authorizations, and register with the appropriate authorities. The VoIPXtreme.com cannot be held responsible for any faults or damages resulting from the Reseller's activities or reselling of the Services.
  31. VoIPXtreme.com allows Customers to broadcast music of their choice while clients are in a calling queue, provided they have the proper licenses and rights to the music. The Customer is responsible for any third-party claims related to the queue music and agrees to defend, indemnify, and hold harmless the VoIPXtreme.com from such claims.
  32. By using the Transcription feature, the Customer agrees that the Company may use third-party service providers to render the Transcription Services and that Customer data may be sent to, hosted, and used by these third parties. The Customer warrants that their use of the Transcription Services complies with applicable laws and regulations and agrees to hold the Company harmless from any claims arising from their use of the Transcription Services.
  33. Business Text Messaging:
    • All businesses sending SMS/MMS traffic in the United States must complete a registration process for their brand and campaign with messaging details.
    • Unregistered messaging traffic may incur additional fees and be subject to filtering, blocking, and fines.
  34. Account Closure due to Inactivity:
    • VoIPXtreme reserves the right to close inactive accounts that remain unused for 12 consecutive months.
    • If an account is flagged as inactive, VoIPXtreme will notify the account holder via email and provide a 30-day period to log in or contact the company. Failure to take action will result in account closure, and VoIPXtreme will not be liable for any losses or damages resulting from the closure.
  35. DID Number Release Fee:
    Customers who wish to release their Direct Inward Dialing (DID) number will incur a fee of $5. This fee will apply if the customer has utilized a total talk time of 4,000 minutes or more within the preceding 30-day period. The fee will be automatically charged to the customer's account at the time of the number release. By requesting the release of a DID number, the customer acknowledges and agrees to this fee structure.
  36. Fraudulent Activity:
    • Call Volume Discrepancy: Accounts exhibiting an outgoing call volume ratio of more than 70% will be flagged for potential fraudulent activity. Additionally, accounts with an outgoing call volume ratio of more than 60% will be flagged if they exceed a maximum limit of 250 outgoing calls per day.
    • Excessive Call Frequency: Any account that initiates more than 1,000 calls within a 24-hour period will be considered for review.
    • Short Call Duration: If more than 50% of outgoing calls from an account have a duration of less than 30 seconds, this will be treated as a potential indicator of fraudulent behavior.
    • Monitoring and Action: We reserve the right to monitor call patterns and usage metrics to detect fraudulent activities. Accounts identified as engaging in suspicious behavior may be subject to immediate suspension or termination of service, pending further investigation. In the event of account suspension, we may require documentation to reactivate your account
  37. Account Verification
    You are required to submit a government-issued identification document for your business and the designated contact person. This verification process is essential to ensure the authenticity of the account holder and to comply with applicable laws and regulations. By submitting the required documentation, you represent and warrant that all information provided is accurate, complete, and up-to-date. We reserve the right to request additional information or documentation as necessary to complete the verification process. Failure to provide the requested information may result in delays in account activation or suspension of services.
    We are committed to safeguarding your privacy and will handle all submitted documents in accordance with our Privacy Policy. The verification process is part of our ongoing efforts to maintain a secure and trustworthy environment for all users.
    By using our services, you acknowledge and agree to comply with these verification requirements. If you do not agree to these terms, you may not be able to activate your account or access our services.
